THIS IS A LEGAL CONTRACT BETWEEN YOU (“YOU,” “YOUR”) AND WITHIN UNLIMITED, INC. d/b/a SUPERNATURAL (“SUPERNATURAL,” “COMPANY,” “WE” OR “US”) IN CONNECTION WITH YOUR PURCHASE OF AN OCULUS HEADSET (AS DEFINED BELOW) THAT INCLUDES A CORRESPONDING MEMBERSHIP TO THE SUPERNATURAL VIRTUAL REALITY APPLICATION (THE “APPLICATION”).
The terms and conditions of this Bundle Offer apply to your purchase and use of the Bundle (as defined below). Additionally, the terms of this Bundle Offer are subject to the most recent version of the Supernatural Terms of Use located at https://www.getsupernatural.com/terms (the “Terms of Use”), which are hereby incorporated by this reference. To the extent there is a conflict between this Bundle Offer and the Terms of Use, this Bundle Offer will control. This Bundle Offer is valid only in the United States. We may update this Bundle Offer at any time and without notice to you. You are responsible for reviewing this Bundle Offer as your continued use of the Bundle after any changes to this Bundle Offer constitutes your acceptance and agreement to such changes.
All information processed under this Bundle Offer will be done in accordance with our Privacy Policy located at https://www.getsupernatural.com/privacy.
By placing an order for the Bundle (as defined below), completing the Bundle Membership (as defined below) registration process on the Application or our website at https://www.getsupernatural.com (the “Website”), or accessing or using the content, information, services, features, music, images, video, text or any other resources or materials related to Supernatural or the Bundle you (i) acknowledge that you have read and understood this Bundle Offer and (ii) agree to be bound by this Bundle Offer and any future amendments and additions thereto.
Bundle Offer Terms
The Supernatural bundle (the “Bundle”) consists of the following: (i) one (1) Oculus Quest 64GB virtual reality headset purchased directly from Supernatural (the “Oculus Headset”) and (ii) one (1) 12-month Supernatural membership (a “Bundle Membership”). Supernatural reserves the right to change the price or limit the quantities of Bundles available for purchase at any time.
To activate your Bundle Membership, you must unbox and set up the Oculus Headset, download the Application and Supernatural Companion App, and register your Bundle Membership on the Companion App or the Website, using the 12 month membership redeemable code included inside your Bundle box. Your Bundle Membership must be redeemed on the Oculus Headset included with the Bundle. A Bundle Membership runs for twelve (12) months from the date of registration on the Website or the Application, (the “Bundle Period”). Limit one Bundle Membership per account. At the end of the Bundle Period, your membership will automatically convert into our standard twelve (12) month Supernatural annual membership subject to the terms and conditions in place at that time (each a “Supernatural Membership”). Published and quoted prices are in US Dollars and are subject to change without notice to you. If you do not wish to auto-renew your Supernatural Membership beyond the initial twelve (12) month term, you may notify us at any time prior to the end of the Bundle Period by emailing BundleSupport@getsupernatural.com. The Bundle Offer is not redeemable or refundable for cash, subject to applicable law, cannot be combined with other offers, and cannot be exchanged or otherwise transferred for gift cards, promo code(s), or any other alternative product.
Purchases
You agree to (i) provide current, complete, and accurate payment information and (ii) pay all applicable fees related to purchases of a Bundle. By providing a payment method, you: (i) represent that you are authorized to use the payment method that you provided and that any payment information you provide is true and accurate and (ii) authorize Supernatural to charge you for the Bundle. We may suspend or terminate your Bundle Membership and access to Supernatural if your payment is late and/or your offered payment method cannot be processed.
Supernatural has partnered with a third party to provide a payment plan for purchases of the Bundle (the “Payment Plan”). The Payment Plan allows for installments payable over a fixed period of time, as specified herein, and pursuant to the applicable terms and conditions set forth in this Bundle Offer. You acknowledge that until all payments required under the Payment Plan are made in accordance with the terms and conditions set forth herein, your enrollment and participation in the Payment Plan operates only as a reservation and not as an actual Bundle purchase. Your order will be reserved until final payment is made and received and, only at such time, shall your Bundle be deemed to have been officially purchased.
To participate in the Payment Plan, you must add at least one Bundle into your cart, process through the checkout, and select the Payment Plan as the payment option. If you select to make a purchase under the Payment Plan, your purchase will be subject to our Payment Plan provider’s applicable terms and conditions. All inquiries relating to Payment Plan transactions must be directed to the applicable Payment Plan provider, and you hereby acknowledge that Supernatural is not responsible or liable for any actions or omissions of the Payment Plan provider. You acknowledge and agree that failure to make timely payments under the applicable Payment Plan may result in penalties, additional fees, or modifications to the Bundle’s total purchase price.
Returns
You may cancel your Bundle order at any time prior to shipment processing. We will accept returns of your Bundle in exchange for a full refund, no questions asked, if you return the Bundle to us within thirty (30) days of purchase and if the Oculus Headset is undamaged and in good working order upon our receipt. Additionally, if the Oculus Headset delivered with your Bundle fails to function as expected because of a manufacturer’s defect within twelve (12) months of your Bundle purchase date, you may return the Oculus Headset to us for a full refund or exchange for another Oculus Headset. We do not accept returns for any reasons other than those stated in this paragraph. Return shipping fees for any return will be at your own expense.
In order to receive a refund for any return, packaged Oculus Headsets must be returned with all parts and components that were initially included with the Oculus Headset and in substantially the same condition as they were delivered to you. When you make a qualified Oculus Headset return, we will not issue a refund and/or adjustment until we have received and we have had an opportunity to inspect the returned Oculus Headset. Returns will be processed within thirty (30) days upon receipt of the returned Oculus Headset. Any refunds will be applied to the same account, and using the same method of payment, used to place the order.
No Unlawful or Prohibited Use
As a condition of your use of the Bundle, you warrant to us that you will not use the Bundle for any purpose that is unlawful or prohibited by this Bundle Offer, the Terms of Use, the Oculus Terms of Service, or any Supernatural policy or terms that apply to your use of the Bundle and Supernatural.
No Warranty
BY PURCHASING A BUNDLE, YOU ACKNOWLEDGE AND AGREE THAT SUPERANTURAL IS NOT AN AUTHORIZED RETAILER OF THE OCULUS AND HEADSET AND THAT THE OCULUS QUEST MANUFACTURER’S WARRANTY LOCATED AT HTTPS://WWW.OCULUS.COM/LEGAL/LIMITED-WARRANTY/, AND THE RIGHTS GRANTED THEREUNDER, MAY NOT APPLY TO YOUR PURCHASE OF A BUNDLE OR THE CORRESPONDING OCULUS HEADSET. SUPERNATURAL HEREBY DISCLAIMS AND MAKES NO REPRESENTATION, GUARANTEE, OR WARRANTY OF ANY KIND TO YOU, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, REGARDING THE OCULUS HEADSET. EXCEPT AS PROVIDED UNDER AN ACCOMPANYING LICENSE AGREEMENT OR MANUFACTURER’S WARRANTY: (I) YOUR PURCHASE AND USE OF THE OCULUS HEADSET ARE AT YOUR OWN RISK; (II) WE PROVIDE THE OCULUS HEADSET “AS IS”; (III) YOU ASSUME THE ENTIRE RISK AS TO THE OCULUS HEADSET QUALITY AND PERFORMANCE; AND (IV) SHOULD THE OCULUS HEADSET PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR. ALL CLAIMS FOR DEFECTIVE OCULUS HEADSETS SHALL BE HANDLED DIRECTLY BY THE SUPERNATURAL CUSTOMER SUPPORT TEAM IF YOU PROVIDE NOTICE OF SUCH DEFECT WITHIN TWELVE (12) MONTHS OF THE BUNDLE PURCHASE DATE.
IN NO EVENT SHALL SUPERNATURAL OR ITS LICENSORS, DIRECTORS, OFFICERS, EMPLOYEES, OR THEIR RESPECTIVE SUCCESSORS OR ASSIGNS BE LIABLE OR HAVE ANY RESPONSIBILITY FOR YOUR USE OR MAINTENANCE OF THE OCULUS HEADSET, OR IF YOU HAVE PERMITTED ANY UNAUTHORIZED MODIFICATIONS, ADJUSTMENTS, AND/OR REPAIRS.
